Agreement & Waiver
By signing our waiver and checking “I have read and understood the Terms & Conditions,” you agree to all terms outlined in this document. A parent or legal guardian must sign on behalf of any minor participant. By signing, you confirm that you are the parent or legal guardian of the minor being registered.
Rescheduling
Need to change your plans? Use the reschedule link in your confirmation email to select a new date and time. All rescheduling must be completed before your original reservation start time, and some time slots may already be full.
If you’re having trouble rescheduling or your reservation is covered by Peek Protect, contact us at [email protected].
Please note that we do not offer refunds on rentals, but we’re always happy to help you find a new date or apply a full credit toward a future booking. If you purchased Peek Protect coverage at the time of booking, a refund may be available for covered reasons — see the Cancellations & Refunds section below for details.
Arriving on Time
Please arrive on time for your reservation. If you arrive late, your rental time will still end at your originally scheduled completion time. For example, a 2-hour rental beginning at 1:00 pm will end at 3:00 pm regardless of when you arrive. All reservation times are Eastern Time (ET).
Returning Equipment on Time
All rental equipment must be returned by the scheduled end time on your reservation. Rentals returned late will incur additional charges billed in one-hour increments at the standard hourly rate. Late fees are non-negotiable and will be automatically charged to the payment method on file.
Inclement Weather
Your safety is our top priority. If we need to close the rental site due to unsafe conditions — including lightning, heavy rain, extreme wind, or hazardous water conditions — we will contact you as soon as possible and issue a full credit to reschedule at your convenience.
If you have not heard from us regarding a weather-related closure, your reservation will proceed as planned. If conditions are safe and the site is open but you prefer not to paddle that day, you must reschedule before your reservation start time. Reservations not rescheduled in advance and not used will be forfeited.
Returning After Your Scheduled Time
All rental equipment must be returned by the scheduled end time stated on the reservation. Rentals returned after the scheduled time will incur additional charges, applied in one-hour increments at the standard hourly rate. Late fees are non-negotiable and will be automatically charged to the payment method on file. By signing our waiver and checking the statement “I have read and understood the Terms & Conditions,” the guest agrees to these terms.
Cancellations & Refunds — Peek Protect Coverage
We do not offer refunds on rentals. We are always glad to reschedule or apply a full credit toward a future reservation when notified prior to your original reservation start time.
For the option of a refund, our booking platform Peek Pro offers optional Peek Protect Coverage at checkout. This coverage must be added at the time of online booking and cannot be added after your reservation is confirmed.
What does Peek Protect cover? Peek Protect provides a refund if you’re unable to attend due to a covered reason, including accident or illness, transportation disruptions, family or home emergencies, and more. For the full list of covered reasons, visit refundable.me.
How to use Peek Protect: Select the refund link in your confirmation email or visit the Peek refund portal and enter your Order ID (note: this is different from your Booking ID). Protect Group handles all reviews and decisions directly with you, and refund requests may be submitted up to 60 days after the activity date.

Age & Paddling Requirements
For the safety of all participants, the following age requirements apply:
- Under 12: Must ride in a double kayak with an adult
- Ages 12 and up: May paddle solo when accompanied by an adult in a separate kayak or on a paddleboard
- Ages 15–17: May paddle independently with a parent or guardian waiver signed in person
All minors must have a waiver signed by a parent or legal guardian.
Life Jackets
Life jackets (personal flotation devices) are required for all paddlers at all times on the water, regardless of age or swimming ability. Life jackets are provided with every rental. Paddlers who refuse to wear a life jacket will not be permitted on the water and will forfeit their rental without refund.
Equipment Weight Limits
For the safety of all customers, please observe the following weight limits for each type of rental equipment:
- Single kayak: 350 lbs
- Double kayak: 500 lbs
- Paddleboard: approximately 240 lbs
- Loungeboard: 400 lbs

Alcohol Policy
The use of alcohol or controlled substances before or during any rental is strictly prohibited. Customers who appear to be under the influence of alcohol or drugs at the time of their reservation will not be permitted on the water and will forfeit their rental without refund. This policy exists for the safety of all participants and is non-negotiable.
Equipment & Safety
All rental equipment must be used as intended and returned in the same condition it was provided. Customers are responsible for the cost of repair or replacement of any equipment damaged due to misuse or negligence. All paddlers must follow staff safety instructions at all times. Failure to do so may result in termination of the rental without refund.
Assumption of Risk & Release of Liability
Kayaking and paddleboarding involve inherent risks, including water-related hazards, weather conditions, and physical exertion. By signing our waiver, you acknowledge and accept these risks on behalf of yourself and any minor in your care, and you release and hold harmless Third Coast Surf Shop, Inc., its owners, employees, and affiliates from any liability for injuries, damages, or losses arising from participation.
Photo & Media Consent
Photos and videos may be taken at our rental locations for promotional and operational purposes, consistent with our Privacy Policy. Consent is acknowledged as part of the waiver signing process. To opt out, notify us in writing at [email protected] before your reservation.
Severability
If any provision of these Terms & Conditions is found to be invalid, unlawful, or unenforceable under applicable law, that provision shall be deemed severed from the remainder of these Terms & Conditions, which shall continue in full force and effect.
Governing Law
These Terms & Conditions are governed by the laws of the State of Michigan. Any disputes shall be subject to the exclusive jurisdiction of the courts of Berrien County, Michigan.
